California Eviction Process

The California eviction process can get quite complicated. First lets look at the 3 day notice of eviction. Upon receiving notice they will either pay and the matter will end or they will not pay and you can summons a complaint. Once the complaint is filed there are several things that can happen. If they do not respond there is a default judgement and then a sheriff's eviction is issued. If they file an answer then a trial is set and takes place. If you win then a sheriff eviction takes place, if you lose then they stay. If they file a motion to quash or a motion to strike then a hearing takes place. If you lose then you have to start the process over, if you win an answer is filed and a trial is set.
