Non Arms Length Transaction

A non arms length transaction is a less than fair transaction. When one party has more than 50% control of or dominant influence, then the transaction is not fair. When the transaction is not treated fairly, with integrity, and is not legal it is considered a non arms length transaction. If the tax authorities find out about a transaction of this type there will be extra taxes owed. For instance, if a mother sold property she owned (not transferred) to her daughter, that would be a non arms length transaction.
