What Are Subpoenaed Witness Rights
The definition of a subpoena is "after authorization by a Superior Court judge, to subpoena a person to testify or produce property necessary and relevant (1) to an investigation into the possible commission of a class A or B felony or certain other crimes or (2) to determine whether a defense or affirmative defense raised regarding one of these crimes is valid." Although it is required that the subpoena allows the witness to their own counsel be present and the witness also has the right to modify or "quash" the subpoena.
