Plumbing and Piping - Dishwasher air gap-Why need? ... As mentioned, 1A IS to code in florida (FBC/FPC 2004). As long as the line is above (or very near at) the rim of the sink, the sink MUST overflow and then some to go back into the dishwasher. That's simple physics.

The dishwasher cannot fill high enough to submerge the fill port. There has been no discussion about the water connection. The air gap discussed has been on the discharge side. An airgap acts as an 'overflow' only if the hose to the sink trap OR the sink trap itself is partially or completly blocked.
