For places that are public, like national parks, you will most likely need a permit of some sort. It would be wise to consult the town ordinances as that is what usually dictates what is allowable in a specific area. When it comes to water, the rules usually are that it must be done a specific distance from the shore. For example, in California, it must be done 500 yards away. Most importantly, when scattering human remains, remember that they will not look like regular ashes from a fireplace and to dispose of the container in a trash can.

I was just told that it's illegal by probably federal law, to spread the ashes resulting from the cremation of a human body. I find this rather hard to believe. It was added when I questioned ... On a personal note, if you scatter ashes you might want to think awhile about where. From a future memorialization standpoint, it could be very disturbing if the area you pick gets converted into a shopping mall or parking lot.
