Filing a false police report can be either a felony or a misdemeanor, if the police and prosecutor choose to pursue. It would be depend on the state. For instance, in Michigan, filing a false police report would be considered a felony if the crime falsely reported would be a felony. In New York, there are 3 three different statutes for filing false police reports. If adjudged a misdemeanor, filing a false police report can lead to a year in jail.
