A missing person can only be declared legally dead if someone (relatives, presumably) initiates legal proceedings to make it happen. e.g. Lord Lucan disappeared in 1974 but was not declared dead until er, about 1997 I think.

When is a missing person presumed dead? The Social Security Handbook. (See also the SSA's policy interpretation) ... I know bureaucrats aren't known for their work ethic, but wouldn't the judge or somebody at least make a call to the IRS and see if the person's still paying taxes, before declaring them legally dead?
