There is a property right in the air space above the land, and this property right can be invad-ed by overhanging objects, including tree limbs. When tree branches overhang a property line, the aggrieved landowner is not limited to seeking monetary relief for any damage that may have occurred.

Overhanging trees and/or other vegetation from private property onto the highway are dealt with by highway inspectors enforcing the Highways Act (1980 as amended). Please report such matters to customer services who will forward the issue to highways enforcement for action.

For our fence to be built we had to clear out the brush along the rear property line. We spoke to a tree company and they said they could take out the brush and take out the bad trees. Also, since many of our neighbor's trees were overhanging our property - and in bad shape, the tree specialist said he would cut them back.
