Article on patent reexamination by Robert J. Yarbrough ... Reexamination is a creature of statute, specifically 35 U.S.C. 301 et seq. The original reexamination language was added to Title 35 in 1980 and amended in 1984 and 1994. I am not aware that reexamination was allowed prior to that time.
